TERMS & CONDITIONS FOR THE DOC2DOC CONFERENCE GIVEAWAY PROMOTION (The “Promotion”) IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (“TERMS AND CONDITIONS”) BEFORE ENTERING THIS PROMOTION. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND DOC2DOC LENDING, INC. (“D2D”) ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THIS PROMOTION. BY ENTERING THIS PROMOTION, YOU CONFIRM THAT YOU HAVE READ UNDERSTOOD, AND AGREE TO ABIDE BY, THESE TERMS AND CONDITIONS
1. Sponsor: The Sponsor of the Promotion is Doc2Doc.
2. Eligibility: The Promotion is open only to legal residents of the United States and the District of Columbia, excluding Maine, West Virginia, Puerto Rico, and other United States territories, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of Doc2Doc their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and those living in the same household are not eligible to participate in the Promotion. Entries made by any mass duplication, automatic, robotic, or programmed method, or through any promotion entry, notification, or related service, or in any manner not in compliance with the requirements of these Official Rules are invalid and will be disqualified.
3. Agreement to Rules: By entering the Promotion, the attendee (“You”) agrees to comply with and abide by these Official Rules and the decisions of Doc2Doc. You represent and warrant that you meet the eligibility requirements. In addition, you agree to accept Doc2Doc’s decisions as final and binding as they relate to the Promotion. Entrants should look solely to Doc2Doc with any questions, comments, or issues related to the Promotion.
4. How to Enter: The Promotion must be entered by scanning a QR code at a Doc2Doc event. To be eligible, the entry must fulfill all Promotion requirements, as specified. Entries that are incomplete or do not adhere to the rules or specifications of the Promotion may be disqualified at the sole discretion of Doc2Doc. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent these rules, your submission may be disqualified at the sole discretion of Doc2Doc.
5. Prizes: The winner(s) of the Promotion (the “Winner”) will receive the following prizes: ·
The actual/appraised value of prizes may differ at the time of prize award. Doc2Doc shall solely determine the specifics of the prize. No cash or other prize substitution shall be permitted except at Doc2Doc’s discretion. The prize is nontransferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. All prize-related expenses, including without limitation all federal, state, and local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission forDoc2Doc to use the Winner’s name, likeness, and entry for advertising and trade without further compensation unless prohibited by law.
6. Odds of Winning: The odds of winning depend on the number of eligible entries received.
7. Winner Selection and Notification: The Winner will be selected by Selection and Random Draw under the supervision of Doc2Doc. Doc2Doc shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for a Winner’s provision of incorrect or non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt of the prize offered in this Promotion by the Winner is conditioned upon compliance with all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at Doc2Doc’s sole discretion will result in the Winner’s disqualification as winner, and all privileges as winner will be immediately terminated. As a condition of awarding the prize: (1) you consent to Sponsor’s use of your name for promotional purposes, including posting of the winner’s name in a winners list, in social media (such as Twitter® and Facebook®) and via online announcements, without additional compensation, except where prohibited by law and as outlined further herein, and (2) if requested by Sponsor, the Winner is required to sign and return an affidavit of eligibility/publicity and liability release within the time specified by Sponsor. Sponsor decisions are final and binding on all matters relating to this Promotion.
8. Rights Granted by the Entrant: By entering this Promotion (e.g., photo, video, text, etc.), You understand and agree that Doc2Doc and anyone acting on behalf of Doc2Doc or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Promotion, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
9. Terms and Conditions: This promotion is governed by U.S. law, subject to all federal, state, and local laws. The decisions of Doc2Doc are final for all aspects of the Promotion. Doc2Doc reserves the right to verify the eligibility qualifications of any winner. The invalidity or unenforceability of any portion or provision of these Official Rules or an Affidavit will not affect the validity or enforceability of any other provision. If any provision of the Official Rules or an Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed under their terms as if the invalid or illegal provision were not contained herein. If there is a discrepancy between these Official Rules and any other promotion materials, the Official Rules will control and govern this Promotion. Doc2Doc reserves the right, in its sole discretion, to cancel, terminate,modify, or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond Doc2Doc’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. In such cases, Doc2Doc may select a winner(s) from eligible entries received before and/or after the action taken by Doc2Doc if appropriate. Doc2Doc reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Official Rules. Doc2Doc has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to multiple entries from the same user from different IP addresses; multiple entries from the same computer more than that allowed by Promotion rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such an attempt be made, Doc2Doc reserves the right to seek damages to the fullest extent permitted by law. Upon review and approval by Doc2Doc, the prize shall be released by Doc2Doc to the winner(s).
10. Limitation of Liability: By entering the Promotion you agree to release and hold harmless Doc2Doc Lending and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Promotion ; (iii) electronic or human error in the administration of the Promotion or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.
11. Disputes: This Promotion is governed by the laws of the United States, without respect to conflict of law doctrines. By participating in this Promotion, you agree that all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Promotion shall be resolved individually, without resorting to any form of class action, exclusively before a court located in the United States having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Promotion). You further waive all rights to have damages multiplied or increased.
12. Marketing and Privacy Policy: Information submitted with an entry is subject to the Privacy Policy on the Doc2Doc Lending Website which can be found here. Doc2Doc,our service providers, and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes: o Direct marketing. We may send you Doc2Doc-related direct marketing communications as permitted by law, including by email and mail. You may opt out of our marketing communications as described immediately below.
13. The Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social networks that are used to share the Promotion. You understand that you are providing your information to the owner of the Promotion and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social networks.
14. Acceptance of Rules: By participating in the Promotion, You have affirmatively reviewed, accepted, and agreed to all the Official Rules, Terms, and Conditions.
